The ARRA objectives for the Waste Management effort on the Nevada Test Site (NTS) is to support the capability to safely and compliantly receive and dispose 2M ft3 of Low-Level Waste (LLW) and Mixed LLW at the Area 5 Radioactive Waste Management Site at the Nevada Test Site in support of the U.S. Department of Energy Complex in Fiscal Year 2010. NOTE: This action is awarded under Modification no. M077. This action is funded by Recovery Act dollars. Justification for Non-Fixed Price Type of Contract for WA* (added to description in FedBizOpps): Rationale for using other than a fixed price and/or competitive award: Contract Clause DEAR 970.5243.1, Changes (DEC 2000), of the contract authorizes the Contracting Officer to make changes within the general scope of the M&O contract. The work scope being accomplished under the Work Authorization as a result of the receipt of the ARRA funds is within the scope of the contract. The prospects for performing the ARRA scope of work under a firm fixed-price (FFP) contract were evaluated prior issuance of the modification. The work contemplated is highly complex and many variables exist that do not lend themselves to the use of a fixed-price contract (FAR16.601(c)). The National Nuclear Security Administration/Nevada Site Office (NNSA/NSO) has communicated to the M&O contractor that FFP subcontracts shall be utilized to the maximum extent possible in accomplishing the specific tasks executed with ARRA funds.
